How does the sale or purchase of a property in Mallorca work?

  • 1. Talk to us

  • 2. Determination of the sales price
    Before selling, it is advisable to analyze the market to determine the best price for the property. As the owner, we offer you a free market valuation so that you can assess the value of your property yourself and set a suitable price for the sale. We would be happy to meet with you for the market value assessment and inspect your property together.
  • 3. Documentation - File situation of the property
    A number of documents are required for the sale of a property. Important are the extract from the register (Nota Simple), the deed of sale (Escritura), the so-called certificate of habitability (Cédula de habitabilidad) and the energy certificate (certificado energético). We work with clear checklists so that we can prepare the necessary documents together with you. In Mallorca, we are familiar with the issue that some properties have certain problems. A pool, garage or terrace may not have been correctly registered by the previous owner. Not everything is immediately illegal or unsellable. We have experience with these issues and prefer to communicate openly with our sellers and buyers about them.   • 4. Photos, exposé and videos
    We take professional photos of your property at our own expense. Of course, we prefer to do this on a sunny day. Our photographer is always happy when the premises are beautifully decorated. We want to show your property from its best side. We use the photos and data to create a professional exposé as a business card for your house, finca, plot or apartment. We can also produce videos as an option. Dynamic moving images are very popular with prospective buyers and attract their attention.
  • 5. Marketing
    As soon as we have created the exposé, we can start marketing. We have several thousand interested parties in our database and the buyer with the right search criteria could already be registered here. We send out weekly newsletters to inform all customers about a new property in our portfolio. Our large and international partner network will also be informed about your property. Our 6-digit marketing budget will benefit the marketing of your property. We invest in the latest technologies for the marketing of all properties, are strong in online marketing in the areas of SEA, display marketing and SEO, as well as in the use of special software and social media.
  • 6. Viewings
    For viewings, we always coordinate with the owner and inform him about the interested parties who would like to view the property. If they are interested, customers would like to have a second or even third viewing and get to know a property at different times of day. A “night viewing” is particularly atmospheric.
  • 7. Negotiation of the purchase price
    If the buyers decide to enter into price negotiations, we ask them for a written offer, at least by email. We then discuss this bid with the owner and arrange the counter-bid - ideally until an amicable agreement on a purchase price is reached.
  • 8. Preliminary contract
    Once the price has been agreed, a preliminary contract under private law (Contrato de Arras) is drawn up, which sets out the terms of the sale and binds the seller and buyer together. This contract can be drawn up by a lawyer or by KUNZE & PARTNER. The contract can be signed in a circular procedure by scan or email - so you do not have to be here in Mallorca for this. The negotiated price and all modalities are written down. By transferring a deposit of 10% of the purchase price, usually to a notary's escrow account, the contract becomes legally binding. The seller and buyer have until the agreed notary appointment to make all arrangements and preparations. The time between the presentation and the notarization can be as short as a few days or as long as several weeks or months.
  • 9. NIE number - the Spanish tax number
    For the purchase of a property in Spain, all buyers listed on the deed of sale need a Spanish tax number - the so-called NIE number. Obtaining this number from the immigration office of the police is actually a process that, with the necessary experience, only takes a short time. Unfortunately, the appointments are always very rare and you have to plan several weeks to get an appointment. However, we also have a cooperation partner who will apply for and obtain the tax number with you in a short time and for a small fee.
  • 10. The notary appointment
    Once all preparations have been completed, the notary appointment will take place at the invitation of the buyer within the period of the preliminary contract. Before the notary appointment, you can schedule the handover of the property and the reading of the meter readings. The buyer and seller will have their identity cards with them for the notary appointment. With regard to payments, it is easiest if the buyer also transfers the balance and taxes to the notary's escrow account and the notary makes the respective payments after the deed of sale has been signed. Unlike in Germany, in Spain you become the owner of the property immediately after signing the notarial deed of purchase and can dispose of it immediately after the appointment.
  • 11. Application for entry in the land register, re-registration of the property
    The buyer must register the purchase in the register by means of the deed of sale. The notary will not do this automatically. Upon commissioning, a so-called “Gestoria”, a lawyer or tax consultant, will take over the registration in the land register. The Gestoria can also carry out all necessary re-registrations or registrations with the relevant utility companies.
  • 12. Now it's time to enjoy your new property in Mallorca
